IMPLIKASI YURIDIS POLITIK DINASTI BERDASARKAN UNDANG-UNDANG NOMOR 6 TAHUN 2020 TENTANG PEMILIHAN GUBERNUR, BUPATI, DAN WALIKOTA (STUDI KASUS KABUPATEN BIMA)

Abstrak: Praktek politik dinasti kian subur setelah mahkamah konstitusi melalui pembacaan putusan perkara nomor 33/PUU-XIII/2015 mencabut pasal 7 huruf r UU Nomor 8 tahun 2015 tentang pemilihan Gubernur, Bupati dan Walikota karena bertentangan dengan Pasal 28 i ayat (2) UUD NRI 1945. Berdasarkan latar belakang di atas maka peneliti merumuskan masalah yaitu bagaimana implikasi yuridis politik dinasti di Kabupaten Bima berdasarkan Undang-undang Nomor 6 tahun 2020 dan bagaimana dampak politik dinasti di Kabupaten Bima. Hasil penelitian yang dilaksanakan, dapat diambil kesimpulan bahwa implikasi yuridis politik dinasti di Kabupaten Bima berdasarkan Undang-Undang Nomor 6 Tahun 2020 bahwa dinamika politik lokal merupakan bagian dari refleksi ‘wajah’ politik nasional, dan membuka ruang bagi terciptanya politik dinasti, walaupun lahirnya Undang-undang Undang-Undang Nomor 6 Tahun 2020 tentang Pemilihan Gubernur, Bupati, dan Walikota sebetulnya tidak sesuai dengan kehendak rakyat yang tidak menginginkan adanya politik dinasti. Kenyataanya menunjukan lahirnya Undang-undang pilkada membuka keikutsertaan keluarga dari petahana dalam politik dinasti. Melihat data beberapa politik dinasti ternyata Undang-undang tersebut berpengaruh dalam pemilihan kepala daerah. Dampak politik dinasti di Kabupaten Bima yaitu sebagai berikut: politik dinasti dianggap hanya melenggangkan kekuasaan segelintir orang, tidak memberi ruang kepada orang lain yang lebih kompeten, untuk bergabung ke dalam partai atau pemerintahan, sulit menciptakan pemerintahan yang baik dan bersih, dan inasti politik tidak tepat jika diterapkan di Indonesia karena bukan negara kerajaan.
Abstract: The political practice of the dynasty is increasingly fertile after the constitutional court through the reading of the verdict of case number 33 / PUU-XIII / 2015 revoked article 7 letter r of Law No. 8 of 2015 concerning the election of Governors, Regents and Mayors because it is contrary to Article 28 I paragraph (2) of the 1945 NRI Constitution. Based on the background above, researchers formulated the problem of how the juridical implications of dynastic politics in Bima Regency based on Law No. 6 of 2020 and how the political impact of dynasties in Bima Regency. The results of the research carried out, can be concluded that the juridical implications of dynastic politics in Bima Regency based on Law No. 6 of 2020 that local political dynamics are part of the reflection of the 'face' of national politics, and open space for the creation of dynastic politics, although the birth of Law No. 6 of 2020 on the Election of Governors, Regents, and Mayors is not following the will of the people who do not want the existence of Dynastic politics. The birth of the electoral law opened the family participation of the incumbent in dynastic politics. Looking at the data of several dynastic politics it turns out that the law affects the election of regional heads. The political impact of the dynasty in Bima Regency is as follows: dynastic politics is considered to only tolerate the power of a few people, does not give space to others who are more competent, to join the party or government, difficult to create a good and clean government, and political inaction is not appropriate if applied in Indonesia because it is not a royal state.
